A Franklin County Circuit judge last week ordered the transfer of the domain names of 141 illegal Internet gambling sites to the Commonwealth of Kentucky in an effort to stop illegal and unregulated online gaming.

Kentucky is the first state to bring an action against Internet gambling operators that has resulted in the seizure of domain names.

The order came Thursday in response to a suit filed by the Justice and Public Safety Cabinet on behalf of the Commonwealth seeking to force the sites to block access to Kentucky users, or relinquish control of their domains.

Judge Thomas Wingate ordered a forfeiture hearing for Sept. 25 on the matter.

The Justice Cabinet had asked the court to order Internet registrars to transfer control of the domain names to the Commonwealth, pending a hearing on whether forfeiture is required.

“Unlicensed, unregulated, illegal Internet gambling poses a tremendous threat to the citizens of the Commonwealth because of its ease, availability and anonymity,” Gov. Steve Beshear said.

“The owners and operators of these illegal sites prey on Kentucky citizens, including our youth, and deprive the Commonwealth of millions of dollars in revenue. It’s an underworld wrought with scams and schemes.”

By seizing the domain names, Kentucky can require that the illegal casino operators use readily available technology to block their domains from being accessed in the Commonwealth.

Beshear said Kentucky loses tens of million of dollars a year to online gambling, which is illegal in all 50 states. And, he said, the illegal activity has repercussions far exceeding its monetary losses to the Commonwealth:

Unlicensed Internet gambling significantly undermines and threatens horseracing, Kentucky's signature industry and a key tourism industry, by creating unregulated and untaxed competition;
The accessibility of the Internet, and the unregulated and private nature of Internet gambling, creates conduits for youths to log on and place wagers;
The anonymity of the Internet and sophistication of encryption devices make it difficult to trace online laundering schemes; and
The unregulated gaming lacks consumer protections to ensure that individuals who choose to gamble are actually paid for their winnings.

Kentucky law has long reflected its strong public policy prohibiting unlicensed, illegal, and unregulated gambling operations, Beshear noted, adding that the Commonwealth is uniquely suited to bring action against illegal Internet gambling operators.

Sections of KRS Chapter 528 specifically mandate the forfeiture of any gambling devices, such as domain names and websites for Internet gambling, and make it illegal to conduct, promote, advertise, own, profit from or conspire to profit from an illegal gambling operation.

Secretary J. Michael Brown said that site owners, when registering domain names, agree to conditions that stipulate the domain name not be used for illegal purposes. He noted that some online gambling sites already block access to Kentucky users.

“Gov. Beshear has once again demonstrated that he is willing to take bold and innovative steps to protect Kentuckians and Kentucky’s legitimate businesses,” Brown said.

“Illegal Internet gambling poses a unique threat to our Commonwealth. For individuals – particularly our youth – it is tantamount to a virtual home invasion. For some of our vital and most venerable legitimate enterprises, it undermines their exemplary regulatory compliance and siphons away their constituents.

“We are hopeful that once this litigation is concluded, the Commonwealth will be off limits to these illegal purveyors.”

Internet Gambling: 1st Technology Denied, Kentucky to Seize Domain Names

Some good news for the internet gambling industry, it turns out that 1st Technology suffered a major defeat in court recently.  Point-Spreads.com has obtained a letter from the United States Patent & Trademark Office that dismisses 1st Technology's request to vacate a re-examination request of U.S. Patent No. 5,564,001. A copy of the USPTO ruling can be found here. Apparently the USPTO felt the declaration of Scott W. Lewis was improper and it will be expunged from the official file which is currently under review for the validity of the method patent in the first place.

So what does that mean? While it does not get Bodog back their domain names, 1st Technology cannot use the method patent to extort money from other internet gambling companies while the validity of the method patent is under review by the USPTO.

By using the US legal system to secure "royalty/licensing" payments for their method patent, 1st Technology has really been a major cause of damage to beleaguered internet gambling industry over the last several years.  1st Technology has used U.S. Patent No. 5,564,001 to obtain "royalty/licensing" payments from various gaming operators that were not in a position to fight the attacks.  While this is great news for operators currently being attacked by 1st Technology, it will not help Bodog get their domain portfolio back.

This latest ruling by the United States Patent & Trademark Office brings the 1st Technology method patent one step closer to being overturned.

While this is great to hear, its not over yet.  Point-Spreads.com has also learned that the state of Kentucky has been monitoring the way 1st Technology was able to successfully grab the Bodog domain names and has put a plan in motion to seize 141 gambling operators domain names including the domains names WSEX.com, SportsBetting.com, PokerStars.com and FullTiltPoker.com just to name a few.  Here is a complete list of domain names and a copy of the motion to seize domain names filed by the State of Kentucky this past Friday.

Internet gambling operators using United States based registrars to hold their domain name portfolios better look into transferring those domain names to a registrar in jurisdiction that licenses gaming companies fast.  It is unknown at this time if Kentucky will be successful in its attempts to seize the domain names.  Point-Spreads.com will continue to monitor this story as it unfolds.

SAN JOSE, Calif., March 5, 2003


(AP) Federal agents routinely seize property allegedly used in the commission of a crime, anything from a drug dealer's car or speedboat to a hacker's computer.

In a series of raids in recent weeks, the Justice Department has extended such grabs to property that might seem esoteric but worry civil libertarians — Internet domain names.

In one case, the government took over Web sites that it said peddled bongs, roach clips, rolling papers and other paraphernalia used in the consumption of illegal drugs.

Prosecutors also acquired, in a plea agreement, a site called isonews.com whose owner was charged with selling special chips that let pirated titles run on videogame consoles.

In the past, Web sites simply vanished after the computer servers that hosted them landed in police property rooms. But in the recent cases, the sites remained alive, greeting visitors with stern warnings from government agencies.

The trend is alarming online civil liberties groups and legal scholars, who say the government's new tactic risks depriving people of valuable property — their Internet storefronts and thus their livelihoods — as electronic commerce becomes more common.

"If you want to take down a Web site but simply confiscate the servers, operators can always buy other servers," said Michael Overly, an attorney specializing in computer law at Foley & Lardner. "But if they take the domain name away, then they've put the person out of business."

Critics of the Justice Department's recent moves also say they fear the government could use the new method to spy on Web surfers who visit confiscated sites.

"The government is suddenly in a position of being able to monitor the Web-surfing activities of unwitting individuals who believe they are going to a Web site ... but possibly implicating themselves into some law enforcement investigation," said David Sobel, general counsel of the Electronic Privacy Information Center.

Visitors to pipesforyou.com, aheadcase.com and others are now greeted with a message informing them that a Pennsylvania federal court has "restrained" the sites at the request of the Drug Enforcement Administration.

In announcing the indictment last week of 55 people for allegedly selling drug paraphernalia on the Internet, Attorney General John Ashcroft said several sites had been redirected to DEA servers and that prosecutors had asked the court to redirect another "15 to 20 sites within the next 30 days."

The Justice Department did not return repeated phone calls seeking comment on what it plans to do with the sites and their visitor logs.

A DEA spokeswoman, Tara DeGarmo, noted that the domain names in the head shop case were "retained" but not seized pending the outcome of the criminal cases. She referred questions to federal prosecutors, who did not return calls.

That leaves privacy activists guessing.

"You can spin this out to future situations where there are a lot of classes of individuals the government might like to have a list of," such as visitors to terrorism- or biological weapons-related sites, Sobel said.

On the Internet, Web surfers are identified with a unique number, or Internet Protocol address. Devices on the Internet need such an address to send and receive Web, e-mail and other traffic.

Domain names are the Web's equivalent of the front door of a bricks-and-mortar business. But while businesses can physically relocate in the material world, in cyberspace they depend on their domain name. The physical location of the Web site is immaterial.

Among issues that remain unresolved in the courts is whether a domain name constitutes property, or a contract the owner has with the domain name registrar — the company that provided the name. If the former, a domain name could indeed be seized like a car, house or computer.

In the past, domain name registrars have sued to ensure that their offerings are not considered property. Otherwise, Overly said, "they would find themselves at the heart of no end of litigation."

The registrars involved in the head shop investigation either declined to comment or did not return telephone calls.

Domain transfers have in the past occurred as a result of criminal or civil cases, but Overly said the courts would ultimately decide the issue.

"The government has done many things over the years," he said, "that ultimately turn out not to be legal."

LuckyPyramidCasino.com seized by Kentucky Governor, Who is Next to fall?As earlier predicted, the Kentucky Governor Steve Beshear has already successfully seized at least one online gambling domain name called LuckyPyramidCasino.com.  A check of the WHOIS information for this domain name shows that Eric Lycan from the Commonwealth of Kentucky Justice Cabinet is the new administrative contact. The popular registrar ENOM apparently allowed the transfer of the domain name to the state of Kentucky this morning after receiving a order of seizure from a Kentucky judge.

Several top brands that are in jeopardy include GoldenPalace.com, WSEX.com, SportsBetting.com, FullTiltPoker.com, PokerStars.com CakePoker.com, DoylesRoom.com and several others.  Point-Spreads.com broke the news about Kentucky’s effort to steal online gambling domain names yesterday morning and the industry has had little time to react to the news since most of the top executives are en route to Barcelona for a EiG’s annual internet gambling conference.

"If that is not a clear case of abuse of power, I don't know what one is," Joe Brennan, Jr. founder of iMEGA, said.  The Interactive Media Entertainment & Gaming Association was founded to foster cooperation between the online industry and government at all levels, and to promote innovation, openness and freedom on the Internet.

Point-Spreads.com was able to catch up via email with one online gambling operation that had this to say, "I don't think this has anything to do with ICANN....the registrars that are all part of ICANN all got direct letters from the judge and have voluntarily followed the order...the order is against the registrars only as far as I can see. I think all US registered domains are toast....a few other international registrars will also hand the domains over.  Some will not....it is very unlikely that our registrar will comply with this order....or even respond to it. This is going to really shake up the industry and global eCommerce....nobody is going to want to build a business of any sort on the net with US ties.”

Companies that hold the online gambling domain names are currently unable to transfer registrars and ownership.  Point-Spreads.com believes more successful seizures will take place this week if not today and we will continue to monitor this situation for readers.

Kentucky ups stakes in online gambling dispute

The US state has passed an order that could result in some online betting companies having their domain names seized

Some of the biggest and most controversial companies in the online poker industry could be stripped of their internet domain names after state officials in Kentucky won a seizure order from a US court.

The order has been served on domain name registrars for 141 gambling sites that take custom from US players, despite this bring prohibited by Kentucky law and the 2003 Unlawful Internet Gambling Enforcement Act (UIGEA). Targeted firms include the registrars for industry leaders PokerStars and Full Tilt, both of which are small companies based in the UK.

PokerStars and Full Tilt have dominated the online poker industry since UIGEA became law, prompting most other operators – such as London-listed firms PartyGaming, 888 and Sportingbet – to exit the US almost overnight. But with no assets or operations in the US, it remains difficult for the American authorities to monitor or police the US activities of remaining operators.

Nick Wood, managing director of London-based Com Laude, which holds the domain name for PokerStars, said: "We anticipated this could happen and we've developed an action plan which largely consists of us not responding." Milton Keynes-based Safenames, the registrar for Full Tilt, declined to comment.

PokerStars and others are believed to be preparing to send a team of lawyers to Kentucky to fight the legal claim, which is being backed by governor Steve Beshear. They are expected to argue the Kentucky courts have no jurisdiction over dotcom domain names registered overseas. Insiders believe they will side-step arguments about whether or not taking cash from US players is in breach of US law.

In a statement welcoming the order, Governor Beshear said: "The owners and operators of these illegal sites prey on Kentucky citizens, including our youth, and deprive the Commonwealth of millions of dollars in revenue. It's an underworld wrought with scams and schemes." He described them as "leeches on our communities".

He conceded the action was in part designed to protect the interests of local horseracing-related gambling. Beshear has campaigned for more casinos to be licensed in Kentucky, prompting some critics to suggest his attacks on online operators looks morally inconsistent.

Many industry experts suggested the Kentucky action was unlikely to succeed. "This is a stunt," said a Washington attorney, David Stewart.

Last year, online gaming group Bodog lost control of its domain name, which was registered in the US, after a legal dispute. The company quickly resurfaced with a similar name but is believed to have lost significant business as a result.

The latest order from the Franklin circuit court of Kentucky has been served on registrar companies in the US and around the world in procedures set out by the California-based Internet Corporation for Assigned Names and Numbers, which oversees the assignment of domain names.

HighRollersLounge.com second onling gambling domain name seized by Kentucky GovernorIt looks like popular domain name registrar ENOM is complying with the online domain name seizure order issued by a Kentucky judge to the delight of Kentucky Governor Steve Beshear.  Earlier today Point-Spreads.com reported that LuckyPyramidCasino.com was seized and now a second domain name HighRollersLounge.com has its administrative contact information listed as Eric Lycan from the Commonwealth of Kentucky Justice Cabinet.

Founded in Bellevue, Washington in 1997 as a privately held company, eNom is a leading online provider of domain name registration and other online services to small and home-based businesses, individuals, traffic aggregators and resellers. eNom is the second largest domain name registrar worldwide, and the number one registrar for resellers, with the largest, most active distribution network in the domain industry. eNom is accredited by the Internet Corporation for Assigned Names and Numbers (ICANN).

While these brands are not all that popular, the effects of the news has online gambling operators scrambling.  The entire industry has descended on Barcelona this week for parties and networking so the seizures have caught some operators off guard. News of the online gambling domain names is the talk of internet gambling conference EiG as you can well imagine.

Many operators have made contingency plans with just such a move as this in mind

September 24, 2008 -- The news earlier this week that Kentucky state officials are seeking the confiscation of some 141 online gambling domains has been carried widely in mainstream as well as industry media, but has not fazed some forward-thinking operators who had already made contingency plans for such an official action.

The Guardian newspaper in London spoke to Nick Wood, managing director of London-based Com Laude, which holds the domain name for PokerStars. Wood said: "We anticipated this could happen and we've developed an action plan which largely consists of us not responding."

Approached by the newspaper, the UK-based Safenames, the registrar for Full Tilt, declined to comment.

PPA Reacts to Kentucky Situation
State action "sets a precedent for censorship of the Internet by force," says pressure group

September 24, 2008  -- John Pappas, executive director of the more than one million-member Poker Players Alliance (PPA), has issued a statement in regards to legal action taken by the Commonwealth to seize the domain names of Internet gambling websites.

"The Poker Players Alliance is outraged at the actions taken by Kentucky Governor Steve Beshear and the Franklin County Circuit Court to seize the domain names of Internet gambling websites," the statement reads. "We believe this action not only unduly restricts the freedom of Kentucky residents to play games of skill such as poker online, but sets a precedent for censorship of the Internet by force.

"Many of Governor Beshear's arguments -- that online poker is illegal, unregulated, and without a mechanism to capture tax revenue -- are false. Online poker is not illegal under Kentucky law, is regulated in its home jurisdiction, and the Commonwealth of Kentucky chose not to license and regulate poker websites.

"If the Governor truly wants to implement tighter regulations, taxation mechanisms, and consumer protections on Internet gambling, the PPA suggests he publicly support federal legislation by U.S. House of Representatives Financial Services Chairman Barney Frank, H.R. 2460, which would achieve those goals.

"Poker is a game of skill, a true American pastime and has a proud heritage in Kentucky. Simply because the game has evolved into the 21st Century, it should not be treated as suspect activity. Forcefully and secretly seizing control of websites that offer online poker games is not a sound public policy or a sound legal solution."
